What to do

If you or a loved one is facing an immigration issue involving U.S. Immigration and Customs Enforcement (ICE) ...

You should consult with an experienced immigration lawyer. Andy Miri and his office deal with ICE regarding immigrant rights everyday. ICE is the agency responsible for enforcing immigration laws, and Andy Miri practices in this area and can provide guidance and representation.

Following options are available for every immigrant:

Motion for bond/detention defense

An immigration detention defense attorney can help you or your loved one if they’ve been detained by ICE (Immigration and Customs Enforcement) and are threatened with deportation. Detention defense typically involves appearing before a judge in immigration court.

If you’ve already had your court case, there are still other options available

Motion to Reopen Prior Removal

If your case was denied by the Immigration Judge or Board of Immigration Appeals, and you have new evidence to present, you have new relief available or you were represented ineffectively by your attorney you may file a Motion to Reopenyour case. In some cases, you may file a motion to reopen if you failed to appear at your scheduled court hearing and were ordered removed In absentia (In your absence). There are different types of motions to reopen, some filed with the Immigration Court and others with ICE chief counsel. To determine if you are eligible to reopen your case, an immigration attorney at our firm can help you navigate through your options.

Stay of Deportation with ICE (I-246)

When an individual has an enforceable order of removal, enforcement of the order may be suspended through a request for an administrative stay of removal with the Enforcement and Removal Operation “ERO” office of ICE. The administrative stay allows the recipient of the removal order to remain in the U.S for a specified period of time without deportation being enforced. Certain benefits accompany the approval of an administrative stay of removal such as the ability to obtain a work permit.

When to seek help

When to Seek Legal Counsel:

ICE Encounter

If you are approached by ICE agents, it's crucial to know your rights and consult with a lawyer. You have the right to remain silent and the right to an attorney.

Removal Proceedings

If you are facing deportation or removal from the United States, an immigration lawyer can represent you in court and explore options to prevent deportation.

ICE Does Not Provide Lawyers

The government does not provide free legal representation in immigration cases. You must hire an attorney or seek representation from a legal aid organization.

Detention

If you or a loved one is detained by ICE, an attorney can help navigate the legal process, including bond hearings and deportation proceedings.

General Immigration Issues

An attorney can also provide guidance on various immigration matters, such as family-based petitions, green card applications, and citizenship.

Rights During ICE Encounters

You have the right to remain silent and the right to an attorney. It's also important to avoid signing any documents without consulting with legal counsel.

What our clients say about us
The office of Andy Miri working on my brothers case helped spectacular! I’m so happy I was recommended to them by Silvia who connected me to Carolina the assistant. Carolina has helped navigate me and my family through the process of my brothers case and his charges. Andy Miri was right there in the preliminary hearing next to my brother which he himself said he felt very well represented and was able to come home to us the same day. They kept me updated with calls, texts and they don’t get enough credit for the patience they have as we understand my brother isn’t their only client, but they made time to keep us updated. Carolina spoke very well with my mom who spoke only Spanish and help her understand the steps that would take place. Overall their service was great! We would definitely recommend them!
